Tinglysning
Tinglysning (registration in Grunnboken) is the public registration of rights and obligations attached to real property and Housing coop shares. When a document is registered, it is entered in grunnboken and thereby gains rettsvern (legal protection): the registered right is protected against the seller's creditors and against others who later acquire rights in the same property. The rules follow from tinglysingsloven (the Land Registration Act) of 1935. Kartverket is the registration authority for the whole country, a centralised task that was moved from the district courts through the Tinglysingsreformen 2003-2007.
Priority between rights is decided by the time of entry under tinglysingsloven § 20: "først i tid, best i rett", first in time, first in right. A registered right takes precedence over a later registered right, and an unregistered right can lose rank to a later good faith acquirer who registers first (extinctive effect). Housing coop shares are entered in Borettsregisteret, a sub register in the Grunnboken system set up in 2006 and operated by Kartverket.
Typical documents that are registered:
- skjøte, the deed used on change of ownership (blankoskjøte, a blank deed, for deferred transfer)
- mortgage deeds (mortgage loans, execution liens, legalpant)
- easements and agreements (right of way, right of residence, right of first refusal, negative servitutter)
- ground lease agreements on freehold plots
- leases with a term of more than ten years
- declarations of restraint on disposal (limits on the owner's right to dispose of the property)
- opening of bankruptcy and legalpant
Registration itself is voluntary, but necessary in practice. Without registration the buyer has no rettsvern, and the seller's creditors can take execution in the property right up until the transfer has legal protection. Banks require a registered charge before granting a mortgage loan. On transfer of real property, Document duty is payable, calculated on the sale value under dokumentavgiftsloven § 7. The rate is 2.5% and is set by the Storting in the annual duty resolutions. In addition, a fixed registration fee of 545 kroner per document applies (2026). Certain transfers are exempt: inheritance, gifts between spouses and transfer of title in a borettslag.
Since 2017, registration has been electronic for banks, lawyers, estate agents and other professional parties through Kartverket's eDokumentmottak. Electronic registration requires a qualified electronic signature and is normally completed on the same day the document arrives. Private persons can still register on paper, with a processing time of a few days. A registration cannot be reversed once the document has been recorded, not even if it is wrong, so documents must be checked carefully before submission.
Tinglysning differs from registration in the matrikkel: grunnboken is the register of rights, the matrikkel is the register of objects with boundaries, area and buildings. Both are operated by Kartverket, but they have different legal effect and different sets of rules. A blankoskjøte is an example of an arrangement that deliberately delays registration, and it shows how important timing is for transfer of title.
Registration gives Grunnboken positive and negative credibility: a good faith acquirer can rely on what it says, and the state is liable for losses caused by registration errors under tinglysingsloven § 35. This mechanism is why a certified land register extract or certificate of charges from Kartverket is sufficient documentation in most property transactions.
In Placepoint, the registered owner (hjemmelshaver) and key Grunnboken details are shown in the property panel when you click a property on the map. Report: Ownership structure and title shows exactly this distinction: a registered transfer of title changes the hjemmelshaver, a company sale does not.
